Television Jamaica (TVJ) has issued a statement announcing that it intends to take the case against CVM to trial.
This follows Friday’s decision by the Court of Appeal to allow the judgment of Justice David Batts to stand, after he denied TVJ’s application for an injunction.
TVJ had applied for an injunction to bar CVM from airing footage from the IAAF World Athletic Championships in Beijing, China.
TVJ, in a statement said the decision, without more, allows CVM to secure millions of dollars in advertising and sponsorship for a product for which it has not paid.
It adds that this includes taking sponsorship from entities which are direct competitors of sponsors which are underwriting the cost of the rights.
According to TVJ, the judgement does not give any other station the right to live transmission of the World Championships.
TVJ says the decision will have far reaching implications for how commercial rights will be governed in the future and so it will continue to pursue the matter in court.
