A St Catherine man who was accused of shooting at a policeman was yesterday freed in the Gun Court after the cop, under cross-examination, said it was not his personal signature on the original statement which he gave in relation to the case.
Defence lawyer Everton Bird then asked Justice Vivienne Harris to acquit his client, 26-year-old entertainer Odane Newby, of charges of shooting with intent and illegal possession of a firearm.
The prosecutor asked for time to produce the actual statement signed by the complainant.
An adjournment was granted but on resumption, the prosecutor said she was unable to produce any other statement.
In making a no case submission, the lawyer said the evidence given by the policemen was not credible and could not be relied on.
In upholding the submission, the judge said that when the complainant was given the original statement, he identified the signature as his own.
She says the fact that he recanted under cross-examination grossly affects his credibility.
The man was arrested after the policeman testified to witnessing a shooting incident in June 2010 involving the accused man.
